Confused by letter writer’s comments

The headline story on today’s paper has me confused. The case of a woman killed in a traffic collision is brought to court after two years against a suspect who, allegedly, was under the influence of Ambien.

The assistant DA says the judge “discharged Padilla of the homicide by vehicle count.” No reason given. However, in the same paper, the victim’s family writes in letters to the editor that, “the evidence had been routinely destroyed.”

So what is the story? Was the evidence destroyed? If so, by whom? Why did it take two years to bring it to court? Was justice done? The people want to know. At least, I do.
