Man arrested on child sexual assault charges

A man who police say admitted to sexually abusing a 9-year-old child who was often in his care has been arrested.

Jared Martinez, 22, of Roswell, was arrested at 11:57 p.m. Friday by Roswell Police on a charge of criminal sexual penetration, according to the RPD arrest log.

Martinez faces five first degree felony counts of criminal sexual penetration in the first degree of a child under the age of 13, a first degree felony, according to documents filed in Chaves County Magistrate Court Monday.

A Chaves County Detention Center jail population summary report Monday listed Martinez as among the inmates at the center.

An affidavit filed by a member of the RPD’s Criminal Investigative Division states police found out about the sexual abuse last Friday after it was discovered that the victim had brought a knife to school. The victim said he had the knife because he needed it to protect himself from Martinez, who he said had been sexually abusing him.

The affidavit states Martinez later admitted to the victim’s mother and stepfather that he had sexually assaulted the victim and that he was high and drunk when he did so.

Martinez later told investigators he sexually assaulted the victim about two years ago, and from there started engaging in sexual activity with the victim once every three to four weeks while the parents were either out of the house or asleep, according to the affidavit.

He also said that he watched pornography with the victim once.

Magistrate Judge E.J. Fouratt approved a no contact warrant, preventing Martinez from having any contact with the victim or witnesses in the case.

An expedited motion was filed for Martinez’s pretrial preventive detention, to deny him bail pending trial.

Bail can be denied to Martinez pending trial if, at a hearing in Fifth Judicial District Court scheduled for Thursday, it can be proved that no release conditions will reasonably protect other people or the community.
