Bond set for two NMMI cadets accused of sexual assault

Bond was set at $30,000 cash or surety for two New Mexico Military Institute cadets accused of sexually assaulting a juvenile.

Judge Dustin Hunter of the 5th Judicial District Court set the bond for Kiarion Freeman and David Johnson — both 18 years old — when they made their first appearance in Chaves County Magistrate Court.

Both Freeman and Johnson are each charged with one count of criminal sexual penetration of a minor and attempt to commit a felony sexual penetration of a minor.

Both will have to abide by conditions of release if they do make bond, which would include not possessing any firearms or dangerous weapons, not returning to the location where the incident happened and not possess, consume alcohol or enter any liquor establishments.

The two suspects are also not to consume, sell, buy or possess illegal drugs or drug paraphernalia, not leave Chaves County without permission of the court, notify the court of any change of address and maintain contact with their defense attorneys.

Hunter also issued a no-contact order, barring either man from having any contact with the alleged victim. He added that the no-contact order likely forbids either of the accused from setting foot on the NMMI campus where both men are cadets, but the attorneys for both men will likely have opportunities to modify that order later so they can continue their education at NMMI.

Freeman and Johnson were both arrested and taken into custody by New Mexico State Police Monday and booked at the Chaves County Detention Center.

An affidavit filed Monday in Magistrate Court states Freeman and Johnson allegedly sexually assaulted a 15-year-old female cadet several times Saturday night, after the victim had been provided with two alcoholic beverages and escorted to a dorm room.

The two men were arrested following an initial investigation conducted by NMMI officials who had been notified about the incident Sunday and who then, in turn, contacted State Police.

Freeman and Johnson are next scheduled to appear in Magistrate Court at 8:30 a.m. Oct. 1 for a preliminary examination.
