Man charged with criminal sexual contact with a minor

A 61-year-old Roswell man accused of committing sexual acts on a child has been arrested on an outstanding warrant.

Rutilo Nevarez was taken into custody Thursday at 9:15 a.m., according to the police log. No other details about his apprehension were disclosed.

Nevarez was wanted on one count of criminal sexual contact with a minor, second degree, child under 13, unclothed, according to documents filed in Chaves County Magistrate Court.

Court documents state that a woman who lives with Nevarez told police she learned Nevarez allegedly performed sexual acts on the child, who also lives at the residence, each day while she was at work.

The woman contacted police and confronted Nevarez about the reported abuse Wednesday night.

When Nevarez was confronted with the accusations, court documents state he denied them. He then left the house before police arrived.

Magistrate Judge K.C. Rogers during Nevarez’s first appearance in Magistrate Court Friday issued a no-contact order, which prohibits Nevarez from directly or indirectly contacting the child or anyone who might testify in a trial.

Court records indicate the District Attorney’s Office in the New Mexico Fifth Judicial District has filed a motion for the pretrial detention of Nevarez.

A hearing on whether to grant the motion is scheduled for Wednesday in District Court in Chaves County.
