Man pleads not guilty to sexual assault of three children

A 49-year-old man suspected of sexually assaulting three children and showing them pornography has pleaded not guilty to 10 criminal counts.

Court documents state that when Shawn Carter of Hagerman appeared via Google Meet at his arraignment in New Mexico’s Fifth Judicial District Court in Chaves County Monday, he pleaded not guilty to one count each of criminal sexual penetration in the first degree, child under 13, and criminal sexual contact with a minor in the second degree, child under 13; two counts of criminal sexual contact with a minor in the third degree, child under 13; as well as three counts each of enticement of a child and contributing to the delinquency of a minor.

Carter is alleged to have sexually assaulted two of the children — a boy and a girl — and showed them pornography on his cellphone between June 2019 and September 2020, according to court documents.

Police were made aware of the allegations after the girl told her father, who lives in Texas, about them. According to court documents, the father then notified Texas authorities about the allegations, who in turn contacted New Mexico authorities.

Carter is also accused of sexually assaulting a third child — a girl— between 2011 and 2015. The girl, according to documents, told her guardians and later authorities in August about the abuse and that he had shown her pornography.

A warrant was issued for Carter’s arrest and it was served Sept. 22, court documents state.

In October, Judge Thomas Lilley granted a motion by the Office of the District Attorney for New Mexico’s Fifth Judicial District for Carter’s pretrial detention, meaning he will remain in custody up through his criminal trial or unless otherwise ordered by the court.
