Man sentenced to 3 years in sexual assault case

A Roswell man has been sentenced to a three-year prison term on a sexual assault charge.

Court records state that Luis Ledesma-Lozano, 34, was sentenced Monday at a hearing in New Mexico’s 5th Judicial District Court in Chaves County.

Upon completion of his term of incarceration, Ledesma-Lozano will be placed on parole for a period of between five and 20 years and pay $180 in court fees. He begins his sentence with 437 days of credit for time served.

A jury on Sept. 29 found Ledesma-Lozano guilty on one count of criminal sexual penetration in the third degree following a two-day criminal trial.

Taina Colon, deputy district attorney for the 5th Judicial District, in an email Friday said the three-year sentence is the maximum penalty an individual could face for that offense. Because of the violent nature of the charge, Ledesma-Lozano will be required to serve 85% of the sentence.

Ira Shiflett, Ledesma-Lozano’s attorney, did not respond to requests for comment about the sentence before press time Saturday.

Ledesma-Lozano was accused of performing sexual acts on a woman while she was asleep on June 28 following a party at a home where both were guests.

According to court documents, the woman went to sleep in a room of the house when the party ended and later awoke to find Ledesma-Lozano performing sexual acts on her.

The incident was reported the next morning to police, hours after Ledesma-Lozano left the house. Ledesma-Lozano denied the charge.
