Rodrick Rodriguez, 34, of Roswell, was served with an arrest warrant Saturday on two counts of criminal sexual penetration in the first degree, child under 13, and one count of battery, according to court documents filed Monday.

Rodriguez was taken into custody three days after an arrest warrant was issued. Following an initial appearance Monday in Chaves County Magistrate Court, Judge E.J. Fouratt set bond for Rodriguez at $50,000 cash or surety.

Court records state the Chaves County Sheriff’s Office was notified in August of the alleged incidents of sexual assault. The girl told investigators of three incidents in which Rodriguez allegedly performed sexual acts on her while in Roswell, the most recent of which allegedly took place in August, according to court documents.

When later contacted by investigators, Rodriguez denied having ever had sexual contact with the girl.

Electronic court records state Rodriguez was arrested by Roswell police in June 2019 on an out-of-state warrant for failure to register as a sex offender in Texas. The case was subsequently dismissed without prejudice, which means charges could possibly be refiled at a later date.
